Terms of Service

By downloading or using our apps, these terms will automatically apply to you – you should make sure therefore that you read them carefully before using our apps.

You’re not allowed to copy or modify our apps, any part of apps, or our trademarks in any way. You’re not allowed to attempt to extract the source code of our apps, and you also shouldn’t try to translate our apps into other languages or make derivative versions. Our apps themselves, and all the trademarks, copyright, database rights, and other intellectual property rights related to them, still belong to Borgs Japan LLC.

Borgs Japan LLC is committed to ensuring that our apps are as useful and efficient as possible. For that reason, we reserve the right to make changes to our apps or to charge for their services, at any time and for any reason. We will never charge you for our apps or their services without making them very clear to you exactly what you’re paying for.

Our apps stores and processes personal data that you have provided to us, to provide our Service. It’s your responsibility to keep your phone and access to our apps secure. We therefore recommend that you do not jailbreak or root your phone, which is the process of removing software restrictions and limitations imposed by the official operating system of your device. It could make your phone vulnerable to malware/viruses/malicious programs, compromise your phone’s security features and it could mean that our apps won’t work properly or at all.

Google Play Services

You should be aware that there are certain things that Borgs Japan LLC will not take responsibility for. Certain functions of our apps will require our apps to have an active internet connection. The connection can be Wi-Fi or provided by your mobile network provider, but Borgs Japan LLC cannot take responsibility for our apps not working at full functionality if you don’t have access to Wi-Fi, and you don’t have any of your data allowance left.

If you’re using our apps outside of an area with Wi-Fi, you should remember that the terms of the agreement with your mobile network provider will still apply. As a result, you may be charged by your mobile provider for the cost of data for the duration of the connection while accessing our apps, or other third-party charges. In using our apps, you’re accepting responsibility for any such charges, including roaming data charges if you use our apps outside of your home territory (i.e. region or country) without turning off data roaming. If you are not the bill payer for the device on which you’re using our apps, please be aware that we assume that you have received permission from the bill payer for using our apps.

Along the same lines, Borgs Japan LLC cannot always take responsibility for the way you use our apps i.e. You need to make sure that your device stays charged – if it runs out of battery and you can’t turn it on to avail the Service, Borgs Japan LLC cannot accept responsibility.

With respect to Borgs Japan LLC’s responsibility for your use of our apps, when you’re using our apps, it’s important to bear in mind that although we endeavor to ensure that it is updated and correct at all times, we do rely on third parties to provide information to us so that we can make it available to you. Borgs Japan LLC accepts no liability for any loss, direct or indirect, you experience as a result of relying wholly on this functionality of our apps.

At some point, we may wish to update our apps. Our apps are currently available on Android – the requirements for the system(and for any additional systems we decide to extend the availability of our apps may change, and you’ll need to download the updates if you want to keep using our apps. Borgs Japan LLC does not promise that it will always update our apps so that it is relevant to you and/or works with the Android version that you have installed on your device. However, you promise to always accept updates to our appslication when offered to you. We may also wish to stop providing our apps, and may terminate use of it at any time without giving notice of termination to you. Unless we tell you otherwise, upon any termination, (a) the rights and licenses granted to you in these terms will end; (b) you must stop using our apps, and (if needed) delete them from your device.

Changes to This Terms and Conditions
We may update our Terms and Conditions from time to time. Thus, you are advised to review this page periodically for any changes. We will notify you of any changes by posting the new Terms and Conditions on this page.

弊社が開発または運用する各種アプリをダウンロードまたは使用することにより、これらの規約は自動的に適用されますので、アプリを使用する前に必ずお読みください。

1.各種アプリ、またはその一部、または商標をコピーまたは変更することはできません。アプリのソースコードを抽出しようとしたり、アプリを他の言語に翻訳したり、派生バージョンを作成することもできません。アプリ自体と、その商標、著作権、データベース権、およびそれに関連するその他の知的財産権は、引き続きBorgs Japan LLCに帰属します。

2.Borgs Japan LLCは、各種アプリをできるだけ便利で効率的に提供します。そのため、いつでも理由を問わず、アプリを変更したり、サービスを有料にしたりする権利を留保します。明確に何のために支払いをしているのかを示さない限り、アプリまたはそのサービスに対して料金を請求することはありません。

3.各種アプリは、あなたが提供した個人データを処理して、サービスを提供します。ユーザー様のスマートフォンと本アプリへのアクセスを安全に保つことはユーザー様の責任です。したがって、デバイスのOS（オペレーティングシステム）によって課せられたソフトウェアの制限等を取り除くプロセスは推奨されません。これらのプロセスを実行することで、スマートフォンがマルウェア、ウイルスや悪意のあるプログラムに対して脆弱になり、スマートフォンのセキュリティ機能が危険にさらされ、各種アプリが正常に機能しなくなる恐れがあります。

4.各種アプリは、使用されるサードパーティサービスの利用規約を宣言する第三者サービスを使用しています。

5.各種アプリのご利用には、有効なインターネット接続が必要です。接続はWi-Fiまたはご契約のモバイルネットワークプロバイダーによって提供されますが、Wi-Fiにアクセスできない場合やデータ通信量が残っていない場合、Borgs Japan LLCはアプリが完全に機能しないことがあり、この状態に対してBorgs Japan LLCは責任を負いません。
Wi-Fiがない地域でアプリを使用している場合は、ご契約のモバイルネットワークプロバイダーとの契約条件が適用されます。その結果、アプリにアクセスする間の接続に対して、ご契約のモバイルプロバイダーからデータのコストが請求される可能性があります。また、その他、第三者からの料金がかかる場合があります。アプリを使用することにより、お住いの地域、または国以外でデータローミングを利用する場合は、ローミングデータ料金を含むそのような料金に対してユーザー様が責任を負うことになります。各種アプリを使用するデバイスのモバイルネットワーク契約者以外が利用しても、同契約者の許可を取ったと見なされます。
同様に、各種アプリのご利用にあたり、デバイスのバッテリーが切れてサービスを利用できなくなった場合、Borgs Japan LLCは責任を負えません。

6.Borgs Japan LLCが各種アプリの使用に関する責任を負う場合、常に最新かつ正確であるように努めているものの、弊社は第三者に情報を提供する場合があります。Borgs Japan LLCは、各種アプリの機能に完全に依存した結果として直接または間接的に損失を被った場合に対して一切の責任を負いません。

7.各種アプリは予告なく更新されることがあります。また、各種アプリのシステムの要件、および各種アプリを利用するために拡張追加されるシステムの要件は変更される可能性があります。各種アプリを引き続きご利用されたい場合は、各種アプリの追加拡張データをダウンロードし、アップデートする必要があります。ただし、Borgs Japan LLCは、各種アプリがユーザー様のデバイスにインストールされたOSバージョンと互換性があるようことを保証しません。各種アプリの正常なご利用にあたり、ユーザー様は提供されたアップデートを常に受け入れる必要があります。弊社はまた、各種アプリの提供を通知なしにいつでも終了することができます。特にお知らせしない限り、終了時には、（a）各ユーザー様に付与された権利とライセンスが終了し、（b）各ユーザー様はアプリの使用を停止し、必要に応じてデバイスから削除する必要があります。

8.利用規約の変更
Borgs Japan LLCは、本利用規約を更新することがあります。新しい利用規約をこのページに掲載することにより、変更を通知します。

これらの利用規約は2023年5月14日より効力を持ちます。
